Re-Organization Meeting of Town Council

January 5, 2016 6:30 PM

Members Present: Todd Everling, J. Scott Flick, Katie Regan, Clerk Teresa Duke.

Absent: Scott Deyoe and Joyce Higginbottom.

Clerk Teresa Duke called to order the Town Council Re-Organization meeting. Mrs. Duke asked for nominations for President. Mr. Everling nominated Scott Deyoe. The nomination was seconded by J. Scott Flick. Katie Regan abstained. The motion was approved with one abstention. Scott Deyoe will be President for the year 2016. Mrs. Duke asked for nominations for Vice President. J. Scott Flick nominated Todd Everling. Katie Regan seconded the nomination. The motion was approved. Todd Everling was elected Vice President for 2016.

Todd Everling closed the re-organization meeting.

Greentown Town Council Meeting
January 5, 2016 6:45 PM

Absent: Scott Deyoe and Joyce Higginbottom.

Meeting was called to order by Mr. Everling.

Minutes of Previous Meeting: The minutes of the previous meeting were presented for additions or corrections. Mr. Everling asked for a motion to accept. Motion was made by Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Approval of Dockets: General Fund total expenses for December 2, 2015 – January 5, 2016 were $89,757.66. Water Utility was $102,359.16. The Wastewater Utilities totaled $142,928.17. Mr. Everling asked for a motion to accept. Motion was made by Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Items from Attorney: Mr. Peelle is currently working on the Danny Barton case on West Payton Street. Mr. Peelle asked Marshal Bennett to give him an updated status on the property and to give him a list of what is still in violation.

Mr. Peelle received a formal letter from Eastern Howard Schools requesting to be put on the agenda for the January 19th Town Council meeting regarding a answer to a question they asked back at the October 6th Town Council meeting about putting separate water meters on the irrigation systems.

Engineer Report: Dylan Lambermont from Wessler Engineering opened the sealed quotes for exploratory well drilling on new test wells No. 5 and 6.

Mr. Everling asked for a motion to accept Peerless Midwest Inc. quote of $115,000.00 to be paid out of the cash reserve fund (ordinance 2015-9) for exploratory well drilling on new test sites 5 and 6. Motion was made Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Greentown Fire Dept. Report: For the month of November 2015, the Greentown Fire Department had 49 EMS runs, 9 fire and 3 rescue. December 2015 the Greentown Fire Department had 31 EMS runs, 6 fire and 2 rescue. The total runs for 2015 was 650

Police Dept. Report: Reading of the Paper Report. Mr. Everling asked for a motion to accept the report. Motion was made by Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Water Report: Reading of the Paper Report. Mr. Everling asked for a motion to accept the report. Motion was made by Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Street Report: Reading of the Paper Report. Mr. Everling asked for a motion to accept the report. Motion was made by Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Mrs. Duke received a faxed notification from Eugene Miller’s Doctors (Midwest Center for Joint Replacement) requesting that Mr. Miller be allowed to return to work on Monday January the 11th. Council approved Mr. Miller to return to work on January 11, 2016.

Wastewater Report: Reading of the Paper Report. Mr. Everling asked for a motion to accept the report. Motion was made by Mr. Flick. Motion was seconded by Katie Regan. Motion carried.

Old Business: None.

New Business: Mrs. Duke announced that wards 1, 2, and 3 will be up for re-election in 2016 and each election will be for a 4 year term. Current seats are held by J. Scott Flick, Joyce Higginbottom and Katie Regan. The election for Greentown Town Council will be run by the Howard County Clerk.

Mr. Klein gave an update on the water towers. Utility Service Group (USG) has cleaned and installed the new mixing system on the south tower and is waiting for the power hook-up to be done. No date was given but USG will work next on the north tower.

Guests: Mr. Ron Simpson, owner of 128 N. Meridian, gave an update on his progress with the building. Mr. Simpson has indicated that property taxes have been paid. Mr. Simpson has a contract signed with a brick mason to repoint the bricks on the building but due to weather and other obligations the contractor could not give a date when work would begin. Seven (7) dumpsters have been used so far to remove debris. Fifty-four (54) tires have been removed from this site as well.

Mr. Simpson asked the council to drop the lawsuit against him on his building at 128 N. Meridian since the building is showing substantial improvement. Mr. Peelle advised the council not to dismiss the case against Mr. Simpson until the building is deemed safe and secure. There is a status report hearing set for January 26, 2016. The council asked Mr. Peelle to extend the status report hearing since Mr. Simpson is showing progress. Mr. Peelle asked Mr. Simpson how much time he would like and Mr. Simpson would like until June 1, 2016. Mr. Peelle will cancel the January 26th status hearing and have it reset for around the June 1st date.

Lorry Nester asked Mr. Klein about the status on the lead that was found in homes when conducting required testing from Indiana Department of Environmental Management. Mr. Klein stated that the Water Utility is following all of the procedures that are required by IDEM and Greentown water is safe to use.

Questions were brought up again by residents in regards to selling the utilities. The council along with Mr. Klein, Mrs. Duke and Mr. Peelle addressed several aspects that were still being questioned.

Public Hearing on Greentown Wesleyan Church

for Voluntary Annexation

December 1, 2015 6:20 PM

Absent: Joyce Higginbottom.

Mr. Deyoe read the petition by Indiana Central District Wesleyan Church for Greentown Wesleyan Church requesting annexation into the Greentown town limits. Property involved is the following: Parcel(s) 34-05-34-300-004.000-011 / 34-05-34-300-005.000-011. This notice was published in the Kokomo Tribune on December 6, 2015.

Mr. Deyoe asked if anyone had any comments or objections to this annexation. No response from guests.

With no comments, Mr. Deyoe asked for a motion to close the public hearing. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.



Greentown Town Council Meeting

December 1, 2015 6:30 PM

Meeting was called to order by President Scott Deyoe.

Minutes of Previous Meeting: The minutes of the previous meeting were presented for additions or corrections. Mr. Deyoe asked for a motion to accept. Motion was made by Mr. Flick. Motion was seconded by Mr. Adams. Motion carried.

Approval of Dockets: General Fund total expenses for November 18th – December 1st were $20,711.48. Water Utility was $17,685.11. The Wastewater Utilities totaled $97,660.25. Mr. Deyoe asked for a motion to accept. Motion was made by Mr. Everling. Motion was seconded by Mr. Flick. Motion carried.

Items from Attorney: Mr. Peelle has prepared for the council four ordinances, a resolution and a fiscal plan. The council decided to take action on those items under Items from Attorney.

Mr. Deyoe asked for a motion to suspend three readings on RESOLUTION 2015-3, FISCAL PLAN for ORDINANCE 2015-14 and ORDINANCE 2015-14. Motion was made by Mr. Adams. Motion was seconded by Mr. Everling. Motion carried.

Mr. Deyoe read RESOLUTION 2015-3, a RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF GREENTOWN TO ADOPT THE WRITTEN FISCAL PLAN FOR THE ANNEXATION OF LAND. Mr. Deyoe asked for a motion to accept RESOLUTION-3, which includes the FISCAL PLAN FOR ORDINANCE 2015-14. Motion was made by Mr. Everling. Motion was seconded by Mr. Flick. Motion carried.

Mr. Deyoe read ORDINANCE 2015-14, AN ORDINANCE ANNEXING CONTIGUOUS TERRITORY TO THE TOWN OF GREENTOWN, INDIANA. (Greentown Wesleyan Church) Mr. Deyoe asked for a motion to accept ORDINANCE 2015-14. Motion was made by Mr. Adams. Motion was seconded by Mr. Flick. Motion carried.

Mr. Deyoe read ORDINANCE 2015-15, AN ORDINANCE AMENDING ORDINANCE 2015-13, FIXING THE SALARIES OF THE TOWN COUCIL, CLERK TREASURER, TOWN ATTORNEY, TOWN EMPLOYEES, PLAN COMMISSION, AND THE BOARD OF APPEALS FOR THE TOWN OF GREENTOWN, INDIANA. Mr. Deyoe asked for a motion to suspend three readings on ORDINANCE 2015-15. The amended salary ordinance added two new employees, Eric Haupert and Cameron Wright. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

Mr. Deyoe read ORDINANCE 2015-16, AN ORDINANCE AMENDING ORDINANCE 2014-5 ENTITLED AN ORDINANCE FIXING THE SALARIES OF THE TOWN COUNCIL, CLERK TREASURER, TOWN ATTORNEY, TOWN EMPLOYEES, PLAN COMMISSION, AND THE BOARD OF ZONING APPEALS FOR THE TOWN OF GREENTOWN. This ordinance allows the council to give a $125.00 Christmas bonus to specified employees. Mr. Deyoe asked for a motion to suspend three readings on ORDINANCE 2015-16. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

Mr. Deyoe read ORDINANCE 2015-17, AN ORDINANCE RECODIFYING ORDINANCES PREVIOUSLY DUPLICATED BY NUMBER. Mr. Deyoe asked for a motion to suspend three readings on ORDINANCE 2015-17. Motion was made by Mr. Flick. Motion was seconded by Mr. Adams. Motion carried.

Mr. Deyoe read a CONTRACT TO EMPLOY ATTORNYS. Agreement made, effective as of January 1, 2016, by and between the Town Council for the Town of Greentown, County of Howard, State of Indiana, acting by and through its duly authorized officers, herein referred to as “TOWN”, and Peelle Law Office of 105 North Buckeye Street, P.O. Box 1106, Kokomo, IN 46903-1106, herein referred to as “ATTORNEY”. Mr. Deyoe asked for a motion to accept Mr. Peelle’s contract to remain as Town attorney for 2016. Motion was made by Mr. Everling. Motion was seconded by Mr. Flick. Motion carried.

Engineer Report: None.

Mr. Deyoe announced that Greentown’s Waste Water Treatment Plant was selected by ACEC (American Council of Engineering Companies) as a Merit Award winner – a respectable award. There is an Awards Banquet Luncheon on March 3, 2016 at the Marriott North in Indianapolis.

Greentown Fire Dept. Report: None.

Police Dept. Report: Reading of the Paper Report. Mr. Deyoe asked for a motion to accept the report. Motion was made by Mr. Flick. Motion was seconded by Mr. Adams. Motion carried.

The council reviewed the history on Danny Barton’s file for his property on West Payton Street (which goes back to 2011) on nuisance violations. Mr. Deyoe asked Mr. Peelle to be as harsh as he can on legal matters concerning this property. Marshal Bennett will provide to Mr. Peelle color photographs of the property.

Officer Skinner brought a request to the Police Committee to convert his police car to an unmarked car. This would require removing the current decals off the vehicle. After some discussion over this request, Mr. Flick asked to table for further discussion.

Mr. Deyoe asked for a motion to approve for Eugene Miller to be placed on disability pay until 02/12/16. Motion was made by Mr. Adams. Motion was seconded by Mr. Flick. Motion carried.

Wastewater Report: Reading of the Paper Report. Mr. Deyoe asked for a motion to accept the report. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

Park Advisory Board Report: None. The Park Advisory board is collecting Park Surveys until the end of December.

Old Business: None.

New Business: Mr. Deyoe recognized Mr. Adams with a gift from the council for his years of service on the Greentown Town Council.

Mr. Deyoe made notice that Indiana celebrates its 200th anniversary of statehood on December 11, 2016. In anticipation of that singular moment in history, the Indiana Bicentennial Commission will launch the celebratory year on December 11, 2015.

Mr. Adams will read a Proclamation on December 11, 2015 at 12:00 noon EST, and proudly raise the Indiana Bicentennial Flag, as we celebrate the launch of the Bicentennial year in Indiana.

Guests: Mr. Downs complimented Greentown on their use and pick up on leaf bags.

Greentown Town Council Meeting

November 17, 2015 6:30 PM

Meeting was called to order by President Scott Deyoe.

Minutes of Previous Meeting: The minutes of the previous meeting were presented for additions or corrections. Mr. Deyoe asked for a motion to accept. Motion was made by Mr. Flick. Motion was seconded by Mr. Adams. Motion carried.

Approval of Dockets: General Fund total expenses for November 4th – November 17th were $30,327.94. Water Utility was $12,298.03. The Wastewater Utilities totaled $14,527.93. Mr. Deyoe asked for a motion to accept. Motion was made by Mr. Everling. Motion was seconded by Mr. Flick. Motion carried.

Kokomo Humane Society 2016 Contract: Mr. Peelle reviewed the contract and everything is the same including dollar amounts from last year. Mr. Deyoe asked for a motion to accept the 2016 Kokomo Humane Society Contract. Motion was made by Mr. Adams. Motion was seconded by Mr. Flick. Motion carried.

Old Business: Mr. Deyoe read the corrected police report from the month of October 2015. Mr. Deyoe asked for a motion to accept the corrected police report from the month of October 2015. Motion was made by Mr. Flick. Motion was seconded by Mr. Adams. Motion carried.

New Business: Deputy Marshal James Skinner submitted a letter to Marshal Bennett requesting to work a part time security job at the Kokomo Mall. The position is every other Friday and Saturday from 1700 – 2200 at 20 hours a month. This security job will not interfere with Deputy Marshal Skinner’s duties with the Greentown Police Department. Mr. Deyoe asked for a motion to approve a part time security job for Deputy Marshal Skinner at the Kokomo Mall that will not interfere with his Greentown Police Department duties. Motion was made by Mr. Everling. Motion was seconded by Mr. Flick. Motion carried.

The Howard County Department of Emergency Management Office of Homeland Security sent The Town of Greentown a letter explaining the need of updating the Mutual Aid Agreements. Mr. Peelle reviewed the Mutual Aid Agreement. Mr. Deyoe asked for a motion to accept the Confirmation Of And Addendum To Mutual Aid Agreement Between Howard County Department Of Emergency Management And Town Of Greentown. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

Mr. Deyoe read the updated policy for the Town Of Greentown Policies And Employee Benefits. Mr. Deyoe asked for a motion to accept the updated Town Of Greentown Policies And Employee Benefits. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

Mr. Deyoe asked for a motion to suspend three readings on Ordinance 2015-13. An Ordinance Fixing The Salaries Of The Town Council, Clerk Treasurer, Town Attorney, Town Employees, Plan Commission, And The Board Of Appeals For The Town Of Greentown, Indiana. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

Mr. Deyoe read Ordinance 2015-13. An ordinance Fixing The Salaries Of The Town Council, Clerk Treasurer, Town Attorney, Town Employees, Plan Commission, And The Board Of Appeals For The Town Of Greentown, Indiana. Mr. Deyoe asked for a motion to accept Ordinance 2015-13. Motion was made by Mr. Everling. Motion was seconded by Mr. Flick. Motion carried.

Mr. Klein reviewed several applications for the water utility and the wastewater utility employment openings. Mr. Klein interviewed candidates for the job openings and turned in his recommendations over to the town Council for final decision.

The utility subcommittee met with Eric Haupert to fill the wastewater laborer position. Mr. Everling made a motion to hire Eric Haupert for the wastewater laborer for $30,000.00 a year. Mr. Haupert will be on a 90 day probationary period before employee benefits begin. Motion was seconded by Mr. Flick. Motion carried. Mr. Haupert’s employment will start on December 1, 2015.

The utility subcommittee met with Cameron Wright to fill the water department laborer position. Mr. Everling made a motion to hire Cameron Wright for the water department laborer at $26,500.00 a year. Mr. Wright will be on a 90 day probationary period before employee benefits begin. Motion was seconded by Mr. Flick. Motion carried. Mr. Wright’s employment will start on December 1, 2015.

Mr. Deyoe read a letter that will be considered by the Town Council to send to Mr. Alan J. DeBoy, President of Indiana American Water. The letter explained that the council has continued to educate ourselves on the process for investigating the potential sale of the Waste Water and Water Utilities and dealing exclusively with Indiana American may not maximize the potential return of such a transaction to our residents. The Town of Greentown respectfully asks to be released from the Letter of Intent between the Town of Greentown and Indiana American Water dated October 14, 2015.

Mr. Deyoe asked for a motion to terminate the Letter of Intent between the Town of Greentown and Indiana American Water dated on October 14, 2015 and pursue an open market competitive process for operating the utilities in the Town of Greentown. Motion was made by Mr. Everling. Motion was seconded by Mr. Adams. Motion carried.

The Town Council addressed several questions that residents had concerning the potential sale of the utilities. Mr. Deyoe said another option is to not sell the utilities but to find a company to run our utilities.

Guests: Sue Flook asked the Town Council concerning zoning on Cooper Sales on West Payton Street. Cooper Sales is zoned Commercial.

Sue Flook also wanted an update on Danny Barton’s property on West Payton. Marshal Bennett has given Mr. Barton his 3rd warning on a nuisance violation. Mr. Deyoe asked Marshal Bennett to prepare a history on Mr. Barton’s property on West Payton to report to the Town Council on the December 1, 2015 meeting.
